Contest Rules & Regulations

THIS CONTEST IS ONLY OPEN TO CANADIAN RESIDENTS AND RESIDENTS OF THE UNITED STATES OF AMERICA (EXCLUDING PUERTO RICO) AND IS GOVERNED BY CANADIAN LAW AND THE LAWS OF THE PROVINCE OF ALBERTA.

NO PURCHASE NECESSARY. SEE BELOW FOR FULL CONTEST DETAILS. PARTICIPATION IN THIS CONTEST CONSTITUTES YOUR FULL AND UNCONDITIONAL ACCEPTANCE OF, AND AGREEMENT TO BE LEGALLY BOUND BY, THESE CONTEST RULES (THE “CONTEST RULES”).

CONTEST PERIOD

The Contest begins on November 1st, 2025 at 12:00 a.m. Mountain Standard Time (“MST”) and ends on November 30th, 2025 at 11:59 p.m. MST (the “Contest Period”). All entries must be received prior to the closing date. Fairmont Banff Springs (“The Sponsor”) is not responsible for any entries destroyed, mutilated, lost, misdirected or corrupted. Mechanically reproduced entries will not be eligible.

ELIGIBILITY

The Contest is open to all residents of Canada and all residents of the USA (excluding Puerto Rico) provided they have not won any prizes from Fairmont Banff Springs in the past 90 days, and further provided, they have reached the age of majority in their province, territory or state of residence at the time of entry.

All employees of Accor, its respective advertising or promotional agencies, or family members with whom these employees are domiciled are ineligible for participation in the Contest. The Contest is subject to all Federal, Provincial, and Municipal regulations and is void where prohibited by law. HOW TO ENTER

NO PURCHASE NECESSARY. To participate in this Contest you must, at any time during the Contest Period, go to the Contest Entry Page at https://www.banff-springs-hotel.com/party-in-banff-contest/ and complete the entry form. Enter your full name, address and email address, subscribe to the Fairmont Banff Springs email newsletter and confirm acceptance of the Official Rules.

Note: By providing the information requested above, you are agreeing to receive the Fairmont Banff Springs newsletter from The Sponsor. You can opt out at any time.

Should you win;

not defame, misrepresent or contain disparaging remarks about Sponsor or its products;
not be false, inaccurate or misleading;
not violate any law or regulation;
not be libelous, threatening or harassing;
not instigate others to commit illegal activities or violate human rights; and
You will receive one (1) Entry in the Contest when you comply with the above described in Section 3 and in accordance with these Rules. LIMIT (1) ENTRY PER PERSON/ADDRESS DURING THE CONTEST PERIOD. For greater certainty and the avoidance of any doubt, you can only use one (1) Address to participate in the Contest. If it is discovered that you attempted to enter more than once during the Contest Period, then all your Entries will be void. Use of any automated system to submit Entries is prohibited and will result in disqualification.

DRAW AND WINNER SELECTION

On Wednesday, December 3rd, 2025 in Banff, Alberta, at approximately 11:00 a.m. MST, one (1) eligible entrant will be selected by random draw from all eligible entries received during the Contest Period. The odds of winning depend on the number of eligible entries received.

Before being declared a winner: The selected entrant will be contacted by email and notified that they are eligible to win. The selected entrant must reply by email within three (3) business days of notification. The Sponsor will then email, and the selected entrant will be required to sign and return within one two (2) business days of notification a declaration of eligibility and a liability/publicity release, which:

confirms compliance with the contest rules;

releases the Sponsor, its affiliated companies and agents, advertising and promotion agencies, the contest judges and each of their respective officers, directors, agents, representatives, successors and assigns from any liability in connection with the Contest, the entrant’s participation therein and/or the awarding and use or misuse of the prize or any portion thereof; and

grants to the Sponsor the right to use the selected entrant’s name and likeness in any form of advertising relating to the contest without further notice or compensation.

If a selected entrant: (i) cannot be contacted by private message within three (3) business days of selection or there is a return of any prior notification as undeliverable; (ii) fails to correctly answer the skill-testing question; or (iii) fails to return the contest documents within the specified time, then he/she will be disqualified and will forfeit the prize, and the Sponsor reserves the right to select an alternate entrant from among the remaining eligible entries.

THE PRIZE

One (1) winner will receive one (1) 3-night stay at Fairmont Banff Springs in a Suite for two (2) adults, one (1) $1,000 CAD resort credit, suite life perks, and daily breakfast in The Vermillion Room for two (2) adults, one (1) private guided experience for two (2) people. This prize also includes roundtrip economy airfare for two (2) people, departing from a major Canadian or American gateway city closest to the entrant’s residence and return transportation from Calgary International Airport (YYC) to Fairmont Banff Springs.

This prize package must be redeemed before November 30th, 2026 and is subject to hotel availability. Blackout dates include: December 15, 2025 to January 5^th, 2026 and June 1^st, 2026 to September 30^th, 2026 as well as Special/Signature Events; and/or Statutory/Holiday Periods. Blackout dates are subject to change without notice. It is the responsibility of The Winner to book their reservations ahead of the expiration date and entirely at the discretion of The Sponsor to confirm the reservation request.

Unless otherwise specified, winners of prizes of the Contest are responsible for all costs and expenses incurred or related to the use of the prize. Approximate retail value: CAD $8,500 including taxes, tourism improvement fees, and resort fees. Actual retail value of The Prize may be higher or lower based on departure city. The prize must be accepted as awarded, has no cash value, cannot be transferred, substituted, redeemed or added to in any way. All decisions of the judges with respect to any part of the Contest are final.

NOTE: The “Prize” does not include, and the Sponsor will not pay for, transportation to and/or from the major airport closest to the entrant’s residence or any additional expenses incurred while using the prize.

GENERAL

By entering the Contest, each entrant agrees to abide by these Contest Rules. This Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.

Sponsor reserves the right to cancel, suspend, withdraw or amend this Contest in any way, without prior notice or obligation, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of The Sponsor that interferes with the proper conduct of this Contest as contemplated by these Contest Rules. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

You must warrant that your Contest Entry meets the Entry Specifications, set out above. Sponsor reserves the right to deem ineligible and exclude from the Contest any Contest Entry that Sponsor, in its sole and absolute discretion, determines does not meet the Entry Specifications. Your right to submit a Contest Entry must not be restricted in any way. You must be able to provide legal releases for use of your Contest Entry by Sponsor in any format, and materials related to the Contest, including in relation to any third party’s name, likenesses or work (“Third Party Elements”) included in your Contest Entry.

All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to – 4 – the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

By entering the Contest, each entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Entry, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Entry in favour of the Sponsor; and (iii) agrees to release and hold harmless the Contest Parties and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relate in any way to the Entry. For greater certainty and the avoidance of any doubt, the Sponsor reserves the right, in its sole and absolute discretion and at any time, to modify, edit or disqualify any Entry if a complaint is received with respect to the Entry, or for any other reason. If such an action is necessary at any point, then the Sponsor reserves the right, in its sole and absolute discretion, to disqualify the Entry (and corresponding Entry) and/or the associated entrant. If the Sponsor determines, in its sole and absolute discretion, that any Entry does not comply with these Rules for any reason at any time, then the Sponsor reserves the right, in its sole and absolute discretion, to disqualify the Entry (and corresponding Entry) and/or the associated entrant.

Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple email addresses, shall be deemed as tampering and may disqualify you from entering, participating, winning prizes (defined herein), and preclude you from participating in future contests and promotions, at the sole discretion of Sponsor. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions these rules will be judged void.

Without limitation, the Sponsor, its advertising and promotion agencies and the Contest judges will not be liable for any failure of the website during the Contest; for an technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any Entry to be received by the Sponsor, its advertising and promotion agencies or the Contest judges for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Sponsor, its advertising and promotion agencies and the Contest judges will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.

In the event of a dispute, Entries will be deemed to have submitted by the authorized address holder of the email address submitted at the time of entry. “Authorized address holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of an online entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected Entry. The sole determinant of the time for the purposes of a valid online Entry in this Contest will be the Contest server machine(s).

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s Privacy Policy (available at: https://www.banff-springs-hotel.com/privacy-policy/) unless the entrant otherwise agrees to receive further communications from Sponsor.

PÉRIODE DU CONCOURS

Le concours débute le 1er novembre 2025 à 0 h 00, heure normale des Rocheuses (HNR), et se termine le 30 novembre 2025 à 23 h 59 HNR (la « Période du concours »). Toutes les participations doivent être reçues avant la date de clôture.
Fairmont Banff Springs (le « Commanditaire ») n’est pas responsable des participations détruites, mutilées, perdues, mal acheminées ou corrompues. Les participations reproduites mécaniquement ne seront pas admissibles.

ADMISSIBILITÉ

Remarque : En fournissant les renseignements demandés ci-dessus, vous acceptez de recevoir l’infolettre Fairmont Banff Springs du Commanditaire. Vous pouvez vous désabonner en tout temps.

En cas de victoire, votre participation ne doit pas :

diffamer, déformer ou contenir de remarques désobligeantes à l’égard du Commanditaire ou de ses produits;
être fausse, inexacte ou trompeuse;
contrevenir à toute loi ou réglementation;
être diffamatoire, menaçante ou harcelante;
inciter d’autres personnes à commettre des actes illégaux ou à violer les droits de la personne.

Une (1) participation au concours sera attribuée lorsque les conditions ci-dessus auront été respectées conformément au présent règlement. Limite : une (1) participation par personne/adresse pendant la Période du concours.
Pour plus de certitude, une seule adresse peut être utilisée pour participer. Si le Commanditaire découvre que vous avez tenté de vous inscrire plus d’une fois, toutes vos participations seront annulées. L’utilisation de tout système automatisé d’inscription est interdite et entraînera la disqualification.

TIRAGE ET SÉLECTION DU GAGNANT

Le mercredi 3 décembre 2025, à environ 11 h 00 HNR à Banff (Alberta), un (1) participant admissible sera sélectionné par tirage au sort parmi toutes les participations reçues pendant la Période du concours. Les chances de gagner dépendent du nombre total de participations admissibles reçues.

Avant d’être déclaré gagnant, le participant sélectionné sera contacté par courriel et informé de son admissibilité. Il devra répondre dans les trois (3) jours ouvrables suivant la notification.
Le Commanditaire enverra ensuite un courriel contenant une déclaration d’admissibilité et de décharge de responsabilité/publicité, que le participant devra signer et retourner dans les deux (2) jours ouvrables suivant la réception. Cette déclaration :

confirme la conformité au règlement du concours;
dégage le Commanditaire, ses sociétés affiliées, agences de publicité et de promotion, juges du concours, dirigeants, administrateurs, représentants, agents, successeurs et ayants droit de toute responsabilité liée à la participation ou à l’attribution du prix;
accorde au Commanditaire le droit d’utiliser le nom et l’image du gagnant dans toute forme de publicité relative au concours sans autre avis ni compensation.

Si un participant sélectionné :
(i) ne peut être contacté dans les trois (3) jours ouvrables suivant la sélection, ou si tout message est retourné comme non livrable;
(ii) ne répond pas correctement à la question d’habileté mathématique; ou
(iii) ne retourne pas les documents requis dans les délais prescrits,
il sera disqualifié et perdra le prix. Le Commanditaire se réserve alors le droit de sélectionner un autre participant admissible.

LE PRIX

Un (1) gagnant recevra :

un (1) séjour de trois (3) nuits au Fairmont Banff Springs dans une suite pour deux (2) adultes;
un crédit de villégiature de 1 000 $ CA;
les privilèges « Suite Life »;
le petit-déjeuner quotidien pour deux (2) adultes au restaurant The Vermillion Room;
une expérience guidée privée pour deux (2) adultes
les billets d’avion aller-retour en classe économique pour deux (2) personnes à partir de la grande ville canadienne ou américaine la plus proche du domicile du gagnant;
et le transport aller-retour entre l’aéroport international de Calgary (YYC) et le Fairmont Banff Springs.

Ce prix doit être utilisé avant le 30 novembre 2026 et est assujetti à la disponibilité de l’hôtel. Les périodes d’interdiction comprennent : du 15 décembre 2025 au 5 janvier 2026, du 1er juin 2026 au 30 septembre 2026, ainsi que les événements spéciaux ou jours fériés. Ces périodes peuvent être modifiées sans préavis.
Il incombe au gagnant de réserver avant la date d’expiration. Les réservations seront confirmées à la discrétion exclusive du Commanditaire.

Sauf indication contraire, le gagnant est responsable de tous les frais liés à l’utilisation du prix.
Valeur au détail approximative : 8 500 $ CA, taxes, frais d’amélioration touristique et frais de villégiature inclus.
La valeur réelle peut varier selon la ville de départ. Le prix doit être accepté tel qu’attribué, n’a aucune valeur en espèces, n’est ni transférable, ni substituable, ni échangeable.
Toutes les décisions des juges du concours sont définitives.

Remarque : Le prix n’inclut pas le transport entre le domicile du participant et l’aéroport de départ, ni toute autre dépense engagée pendant le séjour.

DISPOSITIONS GÉNÉRALES

En participant au concours, chaque participant accepte de se conformer au présent règlement.
Ce concours est assujetti à toutes les lois fédérales, provinciales et municipales applicables et est nul là où la loi l’interdit. Les décisions du Commanditaire sont finales et sans appel.

Le Commanditaire se réserve le droit d’annuler, suspendre, retirer ou modifier le concours sans préavis, en cas d’erreur, de problème technique, de virus informatique, de falsification, de fraude, d’intervention non autorisée, ou de toute autre cause indépendante de sa volonté compromettant le déroulement du concours.
Toute tentative de compromettre délibérément le fonctionnement légitime du concours constitue une infraction criminelle et civile. Le Commanditaire se réserve le droit d’exercer tous recours prévus par la loi.

Le Commanditaire se réserve le droit, à sa discrétion exclusive, de demander une preuve d’identité et/ou d’admissibilité (notamment une pièce d’identité avec photo émise par le gouvernement). Tout défaut de fournir une telle preuve dans les délais prescrits peut entraîner la disqualification.
L’heure officielle pour déterminer la validité d’une participation sera celle du serveur du concours.

En participant, chaque participant :
(i) accorde au Commanditaire une licence non exclusive et perpétuelle pour publier, reproduire ou utiliser sa participation, en tout ou en partie, à des fins promotionnelles;
(ii) renonce à tous ses droits moraux sur sa participation au profit du Commanditaire;
(iii) dégage le Commanditaire et ses représentants de toute réclamation liée aux droits d’auteur, marques de commerce, atteinte à la vie privée ou diffamation.

Toute tentative d’utiliser des moyens automatisés ou frauduleux (ex. robots, scripts, adresses multiples) entraînera la disqualification.
Les participations en retard, illisibles, incomplètes, falsifiées ou ne respectant pas le règlement seront nulles.

Le Commanditaire, ses agences et les juges du concours ne sont pas responsables :

des pannes de site Web pendant le concours;
de tout problème technique lié aux réseaux téléphoniques, serveurs, systèmes informatiques ou logiciels;
de tout échec de transmission d’une participation;
de tout dommage subi à l’ordinateur d’un participant à la suite du téléchargement de matériel lié au concours.

En cas de litige, les participations seront réputées avoir été soumises par le titulaire autorisé de l’adresse courriel. Le titulaire autorisé est la personne à qui cette adresse a été attribuée par un fournisseur de services Internet ou une organisation responsable de son attribution. Une preuve d’identité pourra être exigée.

En participant, chaque personne consent expressément à ce que le Commanditaire, ses agents et représentants conservent, partagent et utilisent les renseignements personnels fournis uniquement aux fins d’administration du concours, conformément à la politique de confidentialité du Commanditaire, disponible à l’adresse :
